Spain provides creditors with several effective collection paths. The choice depends on whether the debt is documented, disputed, and supported by an enforceable title.
Amicable Collection
Start with a formal requerimiento extrajudicial (demand letter) in Spanish, citing the proceso monitorio as the next step. Professional agencies with Spanish-speaking agents and local addresses achieve 50-70% amicable resolution on claims under 12 months old.
Proceso Monitorio
Spain's most efficient court procedure. Zero filing fees. Available for documented, undisputed claims of any amount. The court gives the debtor 20 days to pay or oppose. No opposition means an enforceable title without trial. Timeline: 4-8 weeks.
Enforcement
Spanish enforcement tools include embargo de cuentas bancarias (bank account seizure), embargo de bienes (property attachment), and embargo de salarios (salary garnishment through the employer). Enforcement is executed by the Juzgado de Primera Instancia.
EU Cross-Border Tools
For EU creditors: European Payment Order, European Account Preservation Order, and automatic recognition under Brussels I Regulation.
Statute of Limitations
5 years (Article 1964, Código Civil). Act before expiry — Spanish courts will not revive time-barred claims.
