That register is checked routinely by Swiss banks, landlords, and counterparties before extending credit, which means the filing carries real reputational weight for the debtor well before any asset is actually seized. Once the Betreibungsbegehren is filed, the Betreibungsamt typically serves the Zahlungsbefehl on the debtor within 3 to 14 days. From service, the debtor has 20 days to pay in full, or 10 days to file a Rechtsvorschlag — an objection that requires no reasons and no fee.
If no Rechtsvorschlag is filed, the creditor can proceed straight to Pfändung (attachment) or Konkurs (bankruptcy) once the relevant waiting periods under the SchKG have passed. If a Rechtsvorschlag is filed, the creditor must first obtain Rechtsöffnung — a court ruling lifting the objection — before enforcement can resume.
Art. 104 of the Swiss Code of Obligations entitles a B2B creditor to default interest once the debtor is in default, which we cite in the letzte Mahnung as a matter of course. The Betreibung sequence itself is governed by Art. 67–74 of the SchKG (Bundesgesetz über Schuldbetreibung und Konkurs).
Industry data puts the recoverable share of a receivable near 94 percent at 30 days past due and below 30 percent past a year, in Switzerland as everywhere else — one more reason the letzte Mahnung goes out immediately, not after a polite delay.
Candor is cheaper than a wasted mandate. If the debtor is already in Konkurs, a fresh Betreibung is the wrong tool — the file belongs with the bankruptcy administration, and we will tell you so at assessment. If the debtor genuinely disputes what you delivered, filing is still often worthwhile given the low cost and public register effect, but expect a Rechtsvorschlag and plan for a Rechtsöffnung action from the outset. And if the claim is past the applicable limitation period, no collector revives it.
