Switzerland's Betreibung system is unlike most European enforcement procedures, starting with a debt collection request rather than a lawsuit, and a strict 10-day Rechtsvorschlag window that can stall the whole process.
Swiss creditors initiate recovery through the Betreibungsamt (debt collection office), not the courts, which issues a formal payment demand as the very first procedural step, distinct from anywhere else in Europe.
If the debtor files a Rechtsvorschlag (objection) within ten days, the Betreibung process stalls entirely and the creditor must go to court to have the objection lifted before enforcement can resume.
For creditors based in the EU or EFTA, the Lugano Convention provides a framework for recognizing and enforcing judgments across the Swiss border, which simplifies what would otherwise be a purely domestic process.
